YourChoice is a community reviews platform. You are responsible for your account and what you post. We may moderate content and remove anything that breaks the rules. Nothing here is legal, medical, or professional advice. Please read these terms carefully.
By accessing or using YourChoice (the “Service”), creating an account, or submitting content (including reviews, photos, or profile information), you agree to these Terms of Use and our Privacy Policy and Community Guidelines (collectively, the “Terms”). If you do not agree, do not use the Service.
YourChoice hosts community reviews of service providers (e.g., healthcare, legal, education, caregivers, and trade services). We are not a provider, broker, or agent and do not endorse any provider. We do not guarantee the availability, qualifications, pricing, or outcomes of any services listed on or linked from the platform. No professional advice. Content on YourChoice is for information only and is not legal, medical, financial, or professional advice. Using the Service does not create an attorney-client, doctor-patient, or other professional relationship. Always consult a qualified professional about your specific situation.
You must be at least the age of majority where you live (or have verifiable parental consent, if applicable). Provide accurate registration information and keep it updated. You are responsible for all activity under your account and for keeping your login credentials confidential. Security: We may require email verification and may request phone verification (SMS one-time passcode) for certain actions (e.g., first review with images, claiming a provider profile, repeated flagging). See the Privacy Policy for details.
If you sign in with Google, Apple, or Facebook, you authorize us to receive your name and email from that provider and to create or link your account. We never receive your social passwords and we do not post on your behalf.
By creating an account, you consent to service communications (e.g., verification codes, security alerts, policy updates) via email or SMS. Standard carrier rates may apply. Marketing messages are sent only if you opt in, and you can opt out at any time (e.g., reply STOP to SMS). Some service/security messages may still be required.
“User Content” includes reviews, ratings, text, photos/images, profile info, and any other material you submit. You represent you own or have the right to submit your User Content and that it does not infringe anyone’s rights or violate the Terms. License to us: You grant YourChoice a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, publish, display, distribute, translate, adapt, create derivative works from, and otherwise use your User Content in connection with operating, improving, and promoting the Service (including in search results, emails, and social previews). You can delete your content, but copies may persist in backups, moderation records, legal holds, or where your content has been shared or relied upon.
User Content – Representations (and Responsibility): By posting or submitting any review, rating, text, or photo, you represent and warrant that it is truthful, based on your first-hand experience, and lawful, and that you have the right to share it. You remain solely responsible for your User Content.
YourChoice exists to raise standards, not to host personal attacks. By posting a review or photo, you agree to be accurate and constructive, focusing on your firsthand experience (what happened, when, outcome).
Prohibited content includes: defamation, harassment, hate speech, threats, doxxing; private information (e.g., full names, addresses, phone numbers, account numbers); sensitive images (faces of private individuals without consent, IDs, medical records, license plates, credit cards); unlawful or infringing content; paid/ fake reviews, conflicts of interest, or undisclosed incentives.
Photos: Upload only what you own rights to; up to the allowed number/size; no graphic or identifying images as described above.
One review per user per provider (unless a new, materially different experience). We may edit for formatting (e.g., trimming pasted personal data), refuse, or remove content at any time for any reason, including alleged violations of these Terms or the Guidelines. We may require additional verification before publishing image reviews.
We may, but are not obligated to, monitor, pre-screen, edit, anonymize, or remove any content at our sole discretion. Our failure to act on any content does not waive our right to act later.
If you believe content is unlawful (including defamatory or privacy-infringing), email legal@yourchoice.bm with: (a) the review URL, (b) the exact text you challenge, (c) why it is unlawful with supporting facts/documents, and (d) your contact details. We may temporarily hide the content while we review, request evidence from both parties, and then decide whether to restore, edit/anonymize, or remove the content in our discretion.
Provider profiles may include information submitted by the provider or sourced from public records/third parties. We do not warrant accuracy or completeness. A “Verified” badge (if used) indicates that YourChoice confirmed a limited piece of information (e.g., ownership of an email/phone, license number as of a date). It is not an endorsement. Verification can expire and may be revoked.
We may offer paid listings, featured placements, sponsored posts, or advertising. Sponsored content will be labeled (e.g., “Sponsored,” “Ad,” or “Promoted”). Paid placement does not affect our moderation rules; sponsored content must comply with these Terms and the Community Guidelines. If you purchase a paid placement or ad: you must have the right to use your materials; you are responsible for targeting, compliance, and any required disclosures; and you grant us the necessary license to deliver, display, and distribute the ad materials on and off the Service.
We may reject, pause, or remove any paid content that violates policy, law, or our guidelines. Metrics and reporting are provided as-is and may be estimates.
When you purchase paid listings or ads, you authorize us (and our payment processor) to charge your selected payment method for the fees shown, taxes, and any applicable recurring charges. If a plan auto-renews, renewal terms and cancellation windows will be clearly disclosed at checkout. You may cancel future renewals at any time via your account settings; cancellations do not retroactively refund past charges unless required by law or specified in the plan. Refunds: Except as required by law or explicitly stated for a given offering, fees are non-refundable once the paid period begins. Chargebacks for valid charges may result in suspension of services.
We may update pricing with reasonable notice. Promotions or credits may have additional terms.
If you use voice-to-text, your audio may be transmitted to a third-party transcription provider solely to convert speech to text and return the result to the Service. We do not authorize such providers to use your audio or transcriptions for their own marketing. See the Privacy Policy for the list of processors and retention details. Do not speak sensitive personal data you would not type into a public review.
You agree not to violate laws or others’ rights; post unlawful, infringing, or deceptive content; interfere with the Service; bypass access controls; scrape/crawl without permission; use automated tools to submit or manipulate content; create multiple accounts to evade moderation; or frame/mirror the Service without permission. We may suspend or terminate accounts that violate these Terms or harm the community.
The Service, including our logos, trademarks, design, and software, is owned by or licensed to YourChoice and protected by IP laws. Except for your User Content and permitted use under these Terms, you may not copy, modify, distribute, or create derivative works of the Service without our written permission. Copyright complaints: contact copyright@yourchoice.bm with (i) your contact info, (ii) a description of the work, (iii) the URL of the allegedly infringing material, (iv) a statement under penalty of perjury that you’re authorized, and (v) your signature.
Our Privacy Policy explains what we collect (e.g., email; optional phone for verification; review photos; and, if enabled, voice-to-text inputs), how we use and share data, and your rights (e.g., under Bermuda PIPA and other laws where applicable). By using the Service, you consent to our data practices as described there.
The Service may link to third-party websites or tools (e.g., map, messaging, or identity services). We do not control those sites and are not responsible for their content or policies. Your use of third-party services is at your own risk and subject to their terms.
We may modify or discontinue features at any time. We may update these Terms; if we make material changes, we will notify you (e.g., by email or an in-product notice). Changes apply going forward from the effective date. Continued use means you accept the updated Terms.
The Service and all content are provided “as is” and “as available.” We do not make warranties ”express or implied ”about accuracy, reliability, availability, or fitness for a particular purpose. YourChoice does not guarantee outcomes from any provider, and we are not liable for decisions you make based on content on the platform.
User Content and Reviews
Use at Your Own RiskYou understand that reviews, ratings, photos, and other user content on the service are created by users, not by YourChoice. User content may be subjective, incomplete, outdated, inaccurate, misleading, offensive, or otherwise objectionable. We do not independently verify or endorse user content. You agree that you access, rely on, and use any User Content at your own risk, and, subject to sections 18 and 18A, YourChoice will not be responsible for any loss or damage.
To the maximum extent permitted by law, YourChoice is not liable for usersubmitted content. YourChoice and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of (or inability to use) the Service, even if we knew or should have known of the possibility of such damages. Our total liability for any claims relating to the Service will not exceed the greater of BMD $100 or the amount you paid to us in the 12 months before the claim. Some jurisdictions do not allow certain limitations; in those cases, some of the above may not apply to you.
YourChoice operates as a neutral platform that hosts and facilitates community reviews submitted by users. We do not create, endorse, or independently verify the accuracy of user-generated content. Under Bermuda common law and analogous principles of “innocent dissemination,” YourChoice is not responsible for any statements, opinions, or materials posted by users, provided that we act expeditiously to remove or restrict access to material once we become aware of a credible legal or policy violation. You acknowledge that:
(a) YourChoice has no general duty to monitor or pre-screen content;
(b) reviews represent the subjective opinions of users, not factual assertions by YourChoice; and
(c) our role is limited to providing technical tools for submission, moderation, and display of such content. Nothing in this clause limits our right to remove or edit content or to cooperate with lawful requests or orders.
You agree to defend, indemnify, and hold harmless YourChoice and its affiliates, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.
We may suspend or terminate your account or access to the Service at any time if we reasonably believe you violated these Terms, posed a risk to users or to us, or for other legitimate reasons. You may delete your account at any time in your settings or by contacting support@yourchoice.bm. Some provisions survive termination (e.g., licenses, disclaimers, limitations of liability, indemnity).
We may restrict features or terminate accounts that repeatedly post unlawful content or repeatedly submit bad-faith or abusive legal notices.
Unless prohibited by local law, these Terms are governed by the laws of Bermuda, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Bermuda, unless we mutually agree to another method (e.g., arbitration). Consumers may have mandatory rights in their home jurisdiction that these Terms cannot override. If YourChoice is incorporated or primarily operating in another jurisdiction, update this section accordingly and confirm references to Bermuda’s Personal Information Protection Act (PIPA) in the Privacy Policy.
Dispute Resolution; No Class Actions; Arbitration
To the maximum extent permitted by law, any dispute, claim, or controversy between you and YourChoice arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved on an individual basis. You may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action.
Except where prohibited by law, and except for claims that may be brought in a small-claims court of competent jurisdiction, you and YourChoice agree that any Dispute will be referred to confidential, final, and binding arbitration before a single arbitrator seated in Bermuda, with the proceedings conducted in English. The arbitration will be conducted in accordance with applicable arbitration law in Bermuda and any rules agreed between the parties or, failing agreement, as determined by the arbitrator. The arbitrator may award the same remedies a court could, but may not conduct a class, collective, or representative proceeding.
Nothing in this section prevents either party from seeking interim injunctive or equitable relief from a court of competent jurisdiction where necessary to protect confidential information, personal data, or intellectual property, or to comply with a legal obligation. If any part of this section is found unenforceable as to a particular claim or remedy, that part will be severed and the remainder will continue in full force, and the unenforceable part will be resolved by a court of competent jurisdiction in Bermuda in accordance with section 21
